The Association
of Towns (AOT) welcomes all users to the AOT website. AOT provides access to this website subject
to the following Terms of Service (TOS). The TOS may be updated by AOT from
time to time without notice.
When using the AOT website and application, all Users are subject to any terms
of service, guidelines or rules applicable to such services that are posted on
the respective website or within the app. All such terms of service, guidelines
and rules are hereby incorporated by reference into the TOS. Unless explicitly stated otherwise, any new
additions or changes to the current website and / or app will be subject to the
TOS.
Acceptance of Terms
By visiting the web site and using the application, all users represent that they
understand and fully accept and agree to all of the following terms of this
TOS, on their own behalf and, if acting on behalf of a local government or
other entity, on behalf of such local government or entity.
Services Provided
AOT has created this website and application to expand and improve services to town
governments, town officials, and town employees by providing access to pertinent
information and a means to conduct transactions online. The service will
provide users with access to variety of resources, including AOT publications,
articles, fora, and more. The website and application contain material that is
owned by or licensed by AOT, including but not limited to the design, layout,
look, appearance, graphics, and text. Reproduction is prohibited other than in
accordance with the law.
Access to Services and Enrollment
Users are responsible for obtaining
access to the website and application, which may involve third-party fees
(including but not limited to internet service provider charges). If a user accesses the website and / or
application, such user represents that they are of legal age and capacity to
form a binding contract and will provide true, accurate, current and complete
information about themselves and, additionally, access and use the website and
application in a manner consistent with and subject to the TOS.
Termination of Account
If a user provides any information
that is untrue or inaccurate or AOT has reasonable grounds to suspect that the
information is untrue, inaccurate, or in violation of the TOS, AOT has the
right to suspend or terminate the user’s account and refuse any and all current
or future use of the website and application.
User Accounts, Password and Security
Upon completion of the enrollment
process, a password will be provided to the user. A user is responsible
for maintaining the confidentiality of their password and login information and
is fully responsible for all activities that occur under their account. In the event a breach of the user’s account
occurs, the user must immediately notify AOT. AOT is not liable for any loss or
damage arising from a user’s failure to comply with the requirements set forth
in the TOS.
Privacy, Security and User Conduct
Any personal information provided by
the user to the website or application is subject to AOT’s privacy policy,

In accessing the website and
application, the user consents to the collection and use of such personal
information as provided for in the privacy policy and asserts that they will
protect any data and / or information accessed through the website /
application from any malicious activity that would impact the integrity of the
information provided on the website / application. The failure to adhere to these protection and
security requirements may result in a suspension or revocation of access to the
website and / or application.
When using the website and / or application, the user asserts that they will
not:

Impersonate any other person or
entity;
2.
Tamper with another user’s account;
3.
Tamper with or forge any AOT
materials, documents, or other information available on the website or
application or misuse such materials or represent them as their own;

Act in a manner that negatively
impacts use of the website or application in real time;

Interfere with or disrupt the
website and or / application or servers or networks connect to the website and
application; and
6.
Violate any local, state, federal or
international law, including the transmission of technical data exported from
the United States or the country in which they reside, when using the website
or application.
When using the website or application, the user agrees to evaluate and bear all
risks associated with such use or any information gleaned therein, including
reliance upon the content provided. To
this end, users may not rely upon any content created by AOT and should consult
with their attorney for any binding advice.
The user asserts that it will not
reproduce, duplicate, copy, sell, trade, resell or exploit for any purpose,
commercial or otherwise, any portion of the website or application, which
includes login information, or use or access to the website and or application.
AOT may disclose any user
information if required to do so by law or if there is a good faith belief that
such disclosure is reasonably necessary to either comply with the law, enforce
the TOS, respond to content violation claims, respond to user customer service
requests, or protect the rights, property, or safety of AOT and its users.
Indeminification
By accessing the website or
application, each user expressly indemnifies and holds AOT and its officers,
employees, agents, partners and sponsors harmless from any claim or demand made
by any third party arising out of content or information the user utilizes
through the website or application, or through the user’s use of or connection
to the website and or application, or the user’s violation of the TOS.
Modification
AOT reserves the right at any time
to modify or discontinue the website and application with or without notice to
its users. AOT will not be liable to any
user or to any other party for modification or discontinuance of the website
and application. Any new modifications to the website or application are
automatically subject to the TOS.
Termination
AOT may, without prior notice and at
its sole discretion, immediately terminate a user’s account and access to the
website and application due to: the user’s breach of the TOS or other
guidelines; requests by law enforcement; the user’s own request; the cessation
of the user’s membership with AOT; technical or security reasons; inactivity,
and / or the user’s engagement in fraudulent activities or violations of the
law.
If the user wishes to terminate
their account, which includes removal of access to the website and application
and deletion of the user’s account information, they shall provide written
notification of such termination to AOT via electronic mail at [email protected].
External Links
AOT’s website and application may
provide links to other websites or resources external to AOT. AOT has no control over these external
websites and is not responsible for any of the information provided on such
external websites, nor liable for any damages or losses caused or allegedly
caused by or in connection with use of the external websites, including third
party AI platforms.
Proprietary Rights
AOT’s website and application and
the necessary software used in connection with same contain proprietary and
confidential information that is protected by intellectual property and state
and federal law. AOT grants each
individual user a personal, non-transferable and non-exclusive right and
license to use the website and application, provided that the user does not, in
any manner, attempt to modify the software.
Governing Law
Any claims that arise from use of
AOT’s website or application shall be governed by the laws of the state of New
York.
Disclaimers
The use of AOT’s website and
application is at the sole risk of the user and are provided on an “as is”
basis. AOT and its officers, employees,
agents, partners and sponsors expressly disclaim all warranted of any kind,
both express and implied, including the warranty of fitness for a particular
purpose, warrant of merchantability and warranty of non-infringement. AOT is

accepts that it may receive communications from AOT regarding the website,

The Association of Towns (AOT) is committed to preserving your privacy when visiting our website or using our application.
